Your data will be processed by Farol D'elite, Unipessoal Lda, legal person no. 518465861 (hereinafter referred to as Date other Homes).®.
A Date other Homes®is responsible for processing your personal data within the meaning of the General Data Protection Regulation (hereinafter GDPR).
Why do we process your information?
Your personal data may be collected and processed by Date Other Homes®, for the following purposes:
- a) To fulfil legal obligations to which Date Other Homes is subject® is subject to, namely communications to the Aliens and Borders Service and invoicing.
- b) For the purpose of executing the Temporary Accommodation Contract for Tourists or the Local Accommodation Management Contract signed with Date Other Homes®, c) For the purposes of contact via email, mobile communications, digital platforms, within the scope of Date Other Homes' marketing strategies, to provide additional services to the stay such as cleaning, transfers and breakfast or grocery service, management of contractual obligations or for the purposes of pre-contractual diligence.®, d) For the purpose of protecting property owned or held by Date Other Homes.®, and for statistical analysis purposes.
Failure to provide personal data for the purposes set out in points a) and b) will result in Date Other Homes® non-compliance with legal obligations imposed on it and the consequent possibility of cancellation of the Temporary Accommodation Contract for Tourists or the Local Accommodation Management Contract entered into, without the right to any compensation, as well as a deficient provision of services by Date Other Homes® which cannot be attributed to him.
What kind of personal data do we collect?
As part of its activity, Date Other Homes® will collect and process the personal data necessary for the provision of the contracted services, requests for information or pre-contractual management, namely identification, contact, bank or payment card data.
What do we process your information for?
The processing of your personal data will be carried out on the basis of the execution of the Temporary Accommodation Contract for Tourists, the Local Accommodation Management Contract and the fulfilment of legal obligations imposed on Date Other Homes.® , The GDPR also applies to the entry, stay and exit of foreigners into national territory and tax legislation (Article 6(1)(b) and (c) of the GDPR).
In addition, the personal data collected for the purposes set out in point c) above is based on the consent you have given to Date Other Homes.® for the respective processing (Article 6(1)(a) of the GDPR).
For the purposes set out in point d) above, Date Other Homes will®, will process personal data based on its legitimate interests (Article 6(1)(f) of the GDPR).
How long do we keep your information?
Without prejudice to legal provisions, regulations or court orders to the contrary, the personal data collected will only be kept for the minimum period necessary for the purposes for which it was collected or subsequently processed.
Who can we pass your personal data on to?
A Date Other Homes® may have to share some of your personal data with other recipients. These recipients include:
a) Organisations and/or companies affiliated to Date Other Homes® as long as they comply with an equivalent personal data protection policy.
b) Public organisations to which Date Other Homes® is legally obliged to provide information, namely the Aliens and Borders Service and the DGCI - General Tax Directorate.
c) Subcontractors who provide certain services related to your personal data under the cover of a subcontract and for the sole purpose of providing technical assistance to Date Other Homes.®. These include website hosting providers, mail marketing service providers, cleaning service companies, law firms, accountancy firms and insurance companies.
d) The competent authorities to which Date Other Homes® is legally obliged to disclose information in the course of legal proceedings or to detect technical and/or security problems, such as judicial bodies or competent supervisory authorities.
Is my data transferred to countries outside the European Union?
Your personal data collected by Date Other Homes®, will not be transferred to any entity established outside the territory of the European Union.
Exceptionally and under certain conditions, Date Other Homes® may transfer your personal data to countries outside the territory of the European Union, in accordance with the applicable legislation, namely for the purposes of data hosting or storage, technical subcontracting of processing, back-up and recovery of hosted data, development of services.
A Date Other Homes ®assures you that it will not transfer your personal data to countries that do not guarantee an adequate level of protection, in accordance with the provisions of the GDPR.
What are my rights?
At any time, under the terms of the GDPR, you can request access to your personal data, as well as its rectification or erasure, restriction of processing, the right to object and the right to data portability.
If the requests submitted are manifestly unfounded or excessive, in particular due to their repetitive nature, Date Other Homes will® may require the payment of a reasonable fee taking into account the administrative costs of providing the information or communication, or of taking the measures requested, or refuse to comply with the request.
Regarding the personal data processed by Date Other Homes® if the consent is legitimate, you have the right to withdraw your consent, without the exercise of such right jeopardising the lawfulness of the processing carried out on the basis of the consent previously given, or the subsequent processing of the same data based on another legal basis, such as the fulfilment of the contract or legal obligation to which Date Other Homes is subject.® is subject to.
You also have the right to lodge a complaint with the National Data Protection Commission.
Security and Confidentiality
We are committed to keeping your data secure, and therefore apply appropriate technical and organisational measures to ensure a level of security appropriate to the risk of keeping your personal data on file. However, the transmission of information via the Internet is not completely secure, and we cannot absolutely guarantee the security of information transmitted via our website.
We also respect the confidentiality of your information. As such, we do not sell, distribute or otherwise make your information commercially available to third parties.
